The Supreme Court had recently directed the Governor and the President to decide on fixing a timeline for giving their assent to bills passed by the state assemblies, while hearing a petition filed by the Tamil Nadu government.
Following the direction, vice president Jagdeep Dhankhar sharply criticized the Supreme Court. He said that the supreme powers of the Constitution lie with the Parliament, who has the final authority to decide how the Constitution should be. “Nobody is superior than the Parliament,” he said, despite facing strong opposition.
Now, Chief Justice of India Bhushan Ramkrishna Gavai said, “The judiciary, the executive or the Parliament – who has the supreme powers? Whenever the question arises, we have to remember that the Constitution of India is the superior, and all the three pillars must work for the betterment of the Constitution. They all function under the control of the Constitution. The power of review has been given to the judiciary by the constitution. At the same time, the judiciary is also subjected to review. This is the power of the constitution."
In fact, he tried not just to end the conflict, but also provided clarity to the public. There is no doubt that the Chief Justice's speech was in response to the opinion of Vice President Jagdeep Dhankhar.
The supreme duty of the Supreme Court is to uphold the constitution and protect it. It is not good for democracy for even those in the highest positions to criticize it and obstruct the investigation of the Supreme Court.
